Captain Crosby and the Regimental HQ Scots Guards complained through David Price solicitors that an article was inaccurate. It had suggested, erroneously they said, that an inquiry had been held into allegations that Captain Crosby had an affair with a colleague. There were also a number of other alleged errors.

The matter was resolved when the newspaper published a statement to the effect that the 1st Battalion Scots Guard had clarified that no investigation into Captain Crosby ever took place. The statement also made clear that the battalion was only 40 men short of its full complement at the time the original article had been published rather than 120 as then reported. In addition, the statement reported that the battalion had played a valuable role in the success of recent elections in Iraq.
