Complainant Name:
Mrs Robyn Olney

Clauses Noted: 6

Publication: The Mail on Sunday

Mrs Robyn Olney complained that the newspaper had used a photograph of her son without permission to illustrate an article about his school. The image had previously been taken and used with consent by the complainants local newspaper. She was unhappy that The Mail on Sunday had been able to obtain the image and use it for a different purpose without her knowledge.

The newspaper said that it had obtained the picture legitimately and, because the story did not concern the welfare of the two children in the image, it had not considered there to be a problem in publishing it. Nonetheless, it was sorry to hear of the complainants objection and agreed not to publish the photograph again without obscuring the childrens faces.

Although the complainant remained concerned at the practice of newspapers re-using photographs of children without confirming permission for each use, she was content to regard the matter as resolved.
