Complainant Name:
A teacher

Clauses Noted: 3, 4

Publication: Scottish Sun

A teacher complained that she had been harassed by a reporter who had questioned her about allegations that she had conducted a relationship with a pupil. She was also concerned that her photograph had been taken (when she was outside her house) and published. The complainant explained that the Procurator Fiscal had subsequently decided that there was no case, and would be no proceedings against her.

Although the newspaper did not accept that its reporter had harassed the complainant, the complaint was resolved when the newspaper annotated its records with the details of the case specifically that the Procurator Fiscal had decided that there was no case and undertook not to republish the complainants photograph unless there was a clear public interest to do so.
