Mrs Samantha Enright complained that the newspaper had breached Clause 5 (Intrusion into grief or shock) of the Code of Practice by publishing a partially obscured photograph of her brother shortly after he had taken his own life by hanging. The image had been used to illustrate a report on her brothers suicide, which he had filmed and broadcast in an Internet chat-room.


The matter was resolved when the newspapers representative sent a private letter of apology to Mrs Enright, her surviving brother and their mother. The newspaper also agreed not to use the image again and published the following apology under the heading The family of Kevin Whitrick:

On March 24 2007 we published a partially obscured picture of Kevin Whitrick after he had hung himself.

Mr Whitrick had set up a webcam to broadcast his own suicide on the Internet.

The use of the image caused great distress to his family and we offer our sincere apologies for publishing it.
