Ms Rebecca Smisson of Moray complained that the newspaper had taken (from a website) a photograph of her and her young children and published it without her consent. The article reported how a teenager had taken photographs of young children from the complainants Bebo page (in which she hosted photographs of Moray babies) and used them to pretend that they were of her own dead baby. The article also wrongly implied that it had been photographs of the complainants own children that had been used in this way.


The complaint was settled privately between the two parties, including through an undertaking that the photographs would not be republished.
