Mr Simon Baggott, Company Secretary of Conlin Properties Limited, complained that the newspaper inaccurately reported that Dumfries and Galloway Council had appointed contractors to undertake maintenance works on a property owned by Conlin Properties after the company failed to comply with an Amenity Notice issued by the Council. In fact, the company had undertaken to make the cosmetic improvements already requested by the Council, and were in the process of complying with the Council's request at the time the Amenity Notice was issued. The newspaper printed a follow-up but the complainant took the view that the piece failed to clarify some important points.


The complaint was resolved when the newspaper published a clarification on page two of the newspaper in the following terms:

"Landowner carries out requested work to Whithorn's former Grapes Hotel" (1 January 2009) we made clear that the landowner of the former Grapes Hotel in Whithorn has carried out remedial work to the property. We have also been asked to clarify that the company involved did not fail to comply with a council notice to undertake the work as was reported in our initial coverage of the matter on 18th December 2008. The owner complied with the council's request of its own accord irrespective of a further Amenity Notice (the issue of which was considered unnecessary and inappropriate by the owner who appealed against it as maintenance work was already in process). If the article gave the wrong impression then we are happy to clarify the position.
