Complainant Name:
Mr and Mrs Darnley

Clauses Noted: 1, 5

Publication: Daily Express

Complaint:

Mr W T Darnley and Mrs A M Darnley of Preston complained that an article which reported the tragic death of their daughter, Jenna, contained inaccuracies and intruded into their grief.

Resolution:

The complaint was resolved when the newspaper – which removed the article from its website and marked its databases with a legal warning – published the following apology in addition to writing a private letter of apology to the complainants:

In our article of 5 May 2008, headed “Schoolgirl kills herself over violent death of pal”, we stated that 15-year-old Jenna Darnley had hanged herself a fortnight after witnessing a close friend being beaten to death outside a nightclub in Preston. We accept that Jenna had never met the individual concerned, that she was not in the nightclub and was not with him at the time that he was assaulted. We would like to offer our most sincere apologies to the Darnley family for any distress caused by the article.
