Andrew Chappell complained to the Press Complaints Commission that his photograph had been wrongly used to illustrate an article about possible professional misconduct by a staff member at the Scottish Ambulance Service. The picture was identified as showing the staff member involved, but the complainant (who also works at the Scottish Ambulance Service) had no connection with the incident or the person concerned.

The complaint was resolved privately between the two parties when the newspaper published the following apology on its letters page:

A photograph which appeared on January 30, 2010 captioned "Mercy boss Sam Kennedy" was wrong and an image of Andy Chappell appeared instead. We apologise for any distress or embarrassment caused to Mr Chappell by this mistake.
