Dr Kevin Murray, a member of the Medical Protection Society, complained through Berrymans Lace Mawer LLP to the Press Complaints Commission that the newspaper had published inaccurate information in breach of Clause 1 (Accuracy) in a comment article about legal proceedings relating to Peter Sutcliffe.


The complaint was resolved when the PCC negotiated the publication online, appended to the original article, of the following statement setting out the complainant's position:

We have been contacted by Dr Murray who has raised concerns that the article misrepresents his motivation and conclusions. Dr Murray has had consultant responsibility for this patient for the ten years that he has worked at Broadmoor. Dr Murray has asked us to point out that he did not, and has not, supported the patient's "bid to be freed". His report to the court set out his conclusions following a full clinical assessment. However, Dr Murray is bound by his duty of confidentiality and, therefore, confidential information relating to his patient or the court proceedings is not included in this statement.

We accept that Dr Murray is a leading expert in this field who qualified in medicine more than 30 years ago and has more than 20 years' experience in forensic psychiatry, and are happy to make it clear that he regards the criticism in the article as unwarranted and unfair. We are content to clarify that the article was written without the author having read Dr Murray's confidential report to the court, and that Dr Murray was not given an opportunity to provide his comments before the article was published.
