Ms Constance Perris considered that the newspaper's online headline had conflated the requirements for Incapacity Benefit with the requirements for Disability Living Allowance in breach of Clause 1 (Accuracy) of the Editors' Code of Practice. She stated that there was no requirement under the Disability Living Allowance for the recipient to be unable to work.


The complaint was resolved when the PCC negotiated the amendment of the online headline and the publication of the following statement:

The headline of this article has been amended to clarify the fact that, unlike Incapacity Benefit, the Disability Living Allowance is not an out-of-work benefit.
