Mr Errol Damelin and Mr Jonty Hurwitz, founders of Wonga, complained to the Press Complaints Commission through Lewis Silkin solicitors that the newspaper had acted in breach of Clauses 3 (Privacy), 4 (Harassment) and 10 (Clandestine devices and subterfuge) of the Editors' Code of Practice. The complainants were concerned about attempts to obtain information about their private tax affairs via the Wonga press office. They were also concerned about a journalist's approach to the private homes of Mr Damelin and Mr Hurwitz.

The newspaper did not accept that it had acted in breach of the Editors' Code. The matter was resolved, however, when the newspaper agreed to circulate an internal warning noting that the complainants did not want journalists to approach their private homes "in attempts to discover information concerning their private lives or finances".
