Mr Orhan Bicer complained to the Press Complaints Commission about an article which was, in his view, inaccurate and misleading in breach of Clause 1 (Accuracy) of the Editors' Code of Practice.

The article reported that gates ‘blocking off a road outside Akrington Hall' had been removed ‘after council bosses designated [the road] a legal right of way'. According to the complainant, however, no gates had been removed and, in any case the council was not so empowered.


The complaint was resolved when the PCC negotiated the publication of the following correction:

A report from a meeting of the Middleton Township Committee regarding disputed gates in Hall Road, Alkrington, incorrectly stated that the gates had been removed and that a stretch of the road had been designated a restricted by-way. In fact the gates still stand and while it is true that the council has considered making an application to define the area as such a right of way for pedestrians this must first go through a legal process before the proposed right of way becomes law, however this may be legally challenged by the landowners, occupiers or any members of the public.
