Complainant Name:
Mr David Kempton

Clauses Noted: 1

Publication: Daily Mail

Mr David Kempton complained to the Press Complaints Commission that the newspaper had inaccurately stated that the police had granted a "predatory paedophile" bail and had allowed him to keep his passport. The complainant noted that the Crown Prosecution Service and courts were responsible for granting bail, not the police.

The complaint was resolved when the PCC negotiated the amendment of the article's headline to read:

Why was he free? Predatory paedophile from Portugal groomed and raped British girl, 12, before going on the run after CPS gave him bail and let him keep his passport

The following footnote was also appended:

An earlier version of this article incorrectly carried a headline stating the police granted Mr De Alves bail and allowed him to keep his passport. We are happy to clarify that this action was taken by the Crown Prosecution Service.
