Mr John Marsh complained to the Press Complaints Commission, under the terms of Clause 1 (Accuracy) of the Editors' Code of Practice, that the newspaper had inaccurately stated that the Francis report had uncovered evidence of failings within Stafford Hospital that had led to the "unnecessary deaths of thousands of patients".


The complaint was resolved when the PCC negotiated the publication of the following clarification:

"In an article on August 19, we reported that an investigation into Burton's Queen's Hospital was launched in the aftermath of the Mid-Staffordshire Hospitals scandal which led to the unnecessary deaths of thousands of patients. Although the trust has been blamed for unnecessary deaths at Stafford Hospital - and currently faces prosecution over one of them - we accept the exact number has never been established. We are happy to clarify this point."
