Complainant Name:
Mr Stuart Robertson

Clauses Noted: 1, 3

Publication: The Scottish Sun

Mr Stuart Robertson complained to the Press Complaints Commission that the newspaper had published an article in breach of Clause 1 (Accuracy) and Clause 3 (Privacy) of the Editors' Code of Practice. The complainant was concerned that the article had implied that he had given an interview to the newspaper, when he had in fact only given permission for a freelance reporter to use a tribute he had made on Facebook. He was further concerned that the newspaper had published photographs from his Facebook profile without his consent.

The complaint was resolved when the newspaper wrote a letter of apology to the complainant confirming he had not given the newspaper an interview and that he had not provided the newspaper with the photographs, but rather it had obtained them from his Facebook profile.
