Mr John Heritage complained to the Press Complaints Commission that articles which reported on an Italian mother whose baby was delivered by caesarean section following a court order obtained by Mid-Essex NHS trust had inaccurately stated that the order had been obtained by social services, in breach of Clause 1 (Accuracy) of the Editors' Code of Practice.


The complaint was resolved after the PCC negotiated the publication of the following correction:


Following our coverage about the Italian mother who was subjected to an enforced caesarean prior to having her baby removed by social services (Dec 1, 2013), we wish to make clear that the application for the caesarean was made in the Court of Protection by Mid-Essex NHS Trust on 23 August 2012; a care order was sought and obtained by Essex social services as soon as the child was born the following day, 24 August 2012. The precise position relating to the court applications was not clear at time of our publication because a key judgment relating to them, made 15 months earlier, had never been publicised. Following our reports, this and a further judgment were eventually released on 3 and 4 December 2013. We are happy to set the record straight.
