Mr Andrew Curtis of the European Snack Association complained to the Press Complaints Commission under Clause 1 (Accuracy) of the Editors' Code of Practice that the newspaper had published inaccurate information. It had published the results of a survey by Diet Chef which included data which could not be correct. It claimed that 48 million packets of crisps were eaten every day in the UK. Assuming these were the standard size of 25g each, this would amount to 438,000 tonnes of crisps a year. As the total volume for sales of crisps in the UK in 2010 was 149,764 tonnes, the data was impossible and overestimated the size of the market by 192%. For similar reasons, the claim that two thirds of the UK population ate a packet of crisps everyday could not be accurate.

The newspaper offered to publish a letter from the European Snack Association in print and on its website. The complainant, however, suggested that a preferable form of resolution would be the removal of the article from the website. The newspaper removed the article and the complaint was resolved.
